Who Decides? States as Laboratories for Constitutional Experimentation

The Annual Lecture will be delivered virtually in the afternoon on Monday, June 6, 2022. The Honorable Jeffrey Sutton, Chief Judge of the United States Court of Appeals for the Sixth Circuit, and The Honorable Leondra Kruger, Justice of the California Supreme Court, will discuss Chief Judge Sutton’s recent book Who Decides? States as Laboratories of Constitutional Experimentation. The book addresses the nature of federalism, comparing state governments with the federal government. Chief Judge Sutton maintains that the constitutions of individual states should be taken into account when thinking about American constitutional law, and that they play a critical role in protecting the rights guaranteed by the Constitution of the United States itself. The book follows up on his previous book 51 Imperfect Solutions: States and the Making of American Constitutional Law.

Chief Judge Sutton clerked for Justice Lewis Powell, Jr. and Justice Antonin Scalia, was appointed to the Sixth Circuit in 2003, served as Solicitor General of Ohio, and was a partner at Jones Day, among other professional accomplishments. He is a long-time member of the Supreme Court Historical Society.
Justice Kruger clerked for Justice John Paul Stevens, was appointed to the California Supreme Court in 2015, served as deputy assistant Attorney General at the U.S. Department of Justice, Office of Legal Counsel, and served as assistant to the Solicitor General and as Acting Principal Deputy Solicitor General in the U.S. Department of Justice, among other professional accomplishments.
